SPENCER'S GUEST WAIVER & ACKNOWLEDGEMENT FORM

Before receiving any of our services, we kindly ask that you read and sign this Guest Waiver & Acknowledgement Form (the “Form”), which is designed to inform you of important considerations for our services. By signing below, you acknowledge that you have read and understand this Form.
Voluntary Participation
I understand that the services I receive at Spencer’s are entirely voluntary. I acknowledge that these services may include spa, wellness, beauty, body-work, aesthetic, retail, educational, or recreational activities that are offered or provided by Spencer’s (collectively, the “Services”), and that such Services may involve physical touch, use of oils, lotions, and other products or equipment. I further understand that some Services, such as massage treatments, may involve disrobing, but that I shall always be permitted to forego disrobing while receiving any and all Services.
Health Disclosure
Before receiving any Services, I have provided Spencer’s with a complete, accurate and up-to-date written statement of all of my medical conditions, allergies, medications, implants, injuries, infectious diseases, and other circumstances that could affect or be affected by the Services. I understand and agree that Spencer’s will rely exclusively on the written information I supply. I agree that the Services are not to be considered physical or mental health treatment, medical diagnoses, or a substitute for medical care. I understand that any and all information provided in connection with the Services is provided for general information purposes only and does not constitute medical or other professional advice.
Assumption of Risk
I understand that, while rare, certain risks may be associated with massage and spa treatments, including but not limited to muscle soreness, skin irritation, allergic reactions, or injury due to underlying medical conditions. I voluntarily assume all such risks. I understand that I am responsible for my personal belongings while on the premises and that Spencer’s is not liable for any lost, stolen, or damaged items.
Liability Release
I understand that this Form includes a waiver of any liability against Spencer’s and its owners, employees, contractors, agents, and representatives (collectively, “Releasees”) that may arise in connection with the Services. In consideration of the Services provided, I hereby waive, release and agree to hold harmless the Releasees from any and all claims, demands, causes of action, damages, liabilities, losses and costs (including attorneys’ fees) arising out of or relating to the Services or my presence on the Spencer’s premises. This release includes, but is not limited to, liability for personal injury, allergic reactions, or other damages arising from the Services or products used. I agree that any disputes I may have with any Releasee(s) arising from any Services or the interpretation of this Form shall be submitted to confidential and binding arbitration administered by the Judicial Arbitration and Mediation Services (“JAMS”), and not by lawsuit or other court process. Questions of arbitrability shall be subject to arbitration. The arbitration will take place in the county where the Services were performed in accordance with the applicable
JAMS Rules.
I have read and fully understand the above information and I acknowledge that I am voluntarily agreeing to the terms within this Form, without duress or coercion. The terms of this Form may not be altered, amended, or modified except in a writing signed by Spencer’s and me. I agree that if any portion of this Form is determined to be invalid, illegal or unenforceable, the remainder of this Form shall continue in full force and effect.
